Harris Toengkagie is a Partner at Makarim & Taira S. whose expertise is built on almost two decades of representing and advising national and multinational corporations in litigation and dispute resolution, employment matters, real estate, competition, and corporate compliance. 

In litigation, Harris has represented national and international companies in facing commercially related lawsuits, complex civil litigation cases, state administrative disputes, and the enforcement of foreign arbitral awards through Indonesian courts. He provides valuable assistance to clients before, during, and after the investigation process. This includes providing support during questioning by government institutions, such as the police, immigration, and the public prosecution service. 

Extending his expertise to real estate, Harris has successfully dealt with challenging land acquisition matters related to major power plant and property developments. Harris also has extensive experience across the full spectrum of employment advisory, possessing detailed knowledge of intricate and reputationally sensitive employment and remuneration matters across numerous sectors. His work routinely involves assisting clients with both executive and mass recruitments and terminations, grievances and disciplinary matters, and corporate governance. Furthermore, Harris has strong expertise in corporate compliance, helping companies and organisations to ensure adherence to internally established guidelines or industry regulations.

In recognition of his professional achievements, Harris was named one of Indonesia’s Future Legal Leaders by Asia Business Law Journal in 2022.

Litigation and Dispute Resolution

  • Represented a major Indonesian power plant company (a subsidiary of a publicly listed Japanese company) in relation to land disputes in court proceedings
  • Represented a publicly-listed independent power producer company in a state administrative dispute in relation to a pipeline license
  • Represented an Indonesian power plant company in a state administrative dispute in Central Java in relation to one of its main licenses
  • Represented an Indonesian investment company in foreclosure proceedings over a plot of land secured under a land security right (hak tanggungan) through the Indonesian courts
  • Represented an International Hotel Chain company in the enforcement of a foreign arbitral award through the Indonesian courts

Competition

  • Represented clients in several competition law cases in Indonesia, including Temasek Holdings (Private) Limited on an alleged violation of the Indonesian Competition law related to shareholdings in two major Indonesian telecommunications service providers brought by the Indonesian Business Competition Board
  • Represented an Indonesian Entertainment company on an allegation of monopolistic activity in the distribution of entertainment materials

Employment

  • Represented a foreign investment company manufacturing and exporting integrated circuits with regard to the redundancy of more than 200 employees
  • Represented an international major resort chain company in Indonesia in actions related to employment and immigration issues
  • Represented a joint venture company in the oil and gas industry related to mass termination issues due to the closure of the company
