Mark is an Associate Director with the Corporate & Finance Department in Drew & Napier.

Mark’s key areas of practice are Technology, Media, and Telecommunications (TMT), Data Protection, Privacy and Cybersecurity, as well as Artificial Intelligence (AI) and Digital Trust.

Mark advises global MNCs and APAC regulators on legal issues arising in the digital infrastructure and online platforms space, including: telecommunications, broadcasting, online content regulation, data privacy, cybersecurity and resilience, competition and antitrust, as well as AI laws.

These matters span a range of legal work: licensing and regulatory compliance; regulator engagement, approvals and appeals; commercial agreements; as well as investigations and enforcements

  • Advised Singapore’s regulator in the drafting of the Telecommunication & Media Competition Code (TMCC) and Guidelines on Anti-Competitive Agreements, Abuse of Dominance, Mergers and Consolidations.
  • Advised Singapore’s regulator in a study of digital infrastructure key players (ISPs, IXPs, ICPs, and CDNs) cybersecurity and resilience regulation of key digital infrastructure players worldwide, as a precursor to Singapore’s introduction of the Cybersecurity Act 2024 regime regulating ‘foundational digital infrastructure service providers’ i.e. cloud computing and data centre facility service providers.
  • Advised Singapore’s regulator in a study of data centre regulation overseas, including telecommunications, cybersecurity, foreign investment and sustainability laws.
  • Advised a FAANG company in a major project to land and deploy subsea and terrestrial fibre network infrastructure, including cables, landing stations, data centres, SLTE and ducts/earthworks.
  • Advised a FAANG company on a data centre project for the provision / maintenance of cloud computing infrastructure and services to the Singapore government.
  • Advised Singapore’s largest telco in drafting its standard contractual terms and conditions for business and consumer mobile services.
  • Advised a global MNC providing digital media transmission services over cable / fiber / satellite networks to major broadcasters in a merger filing for its proposed acquisition by an investment firm.
  • Advised Singapore’s regulator in its S$113 million 2020 Call for Proposal and S$148.5 million 2022 Auction in relation to 5G mobile spectrum rights.
  • Advised Singapore’s regulator in reviewing the national fibre broadband network monopoly owner‘s proposal to expand into overseas markets beyond fibre infrastructure.
  • Assisted Singapore’s regulator in drafting a network security code of conduct requiring telcos, SMS aggregators and Internet service providers to adopt measures to counter online fraud / identity theft.
