Singapore | Appellate Division of the High Court Clarifies Civil Standard of Proof

In Ma Binxiang v Hainan Hui Bang Construction Investment Group Ltd [2022] SGHC(A) 37, the Appellate Division of the High Court held that Courts should not adopt a “binary approach” of deciding between the plaintiff’s case and the defendant’s case without considering the possibility that the plaintiff has failed to discharge his burden. Greater scrutiny of a trial judge’s findings is warranted if a trial judge was overly influenced by a comparison of two competing versions of events.
