Singapore | The science of the art of sentencing: Demystifying the sentencing framework for “purely private sector corruption”
Takaaki Masui & anor v Public Prosecutor [2020] SGHC 265 involved one of Singapore’s largest private sector corruption cases in history.
However, the High Court’s decision was particularly ground-breaking as the High Court relied significantly on statistical analysis (to the extent of employing the aids of graphs, algebra and even 3D modelling) to derive a sentencing framework for “purely private sector corruption”.
This article seeks to deconstruct and demystify the High Court’s decision. In particular, this article examines how the High Court’s decision empowers sentencing judges to analyse every case on its own unique facts to arrive at a just sentence.
