Singapore | Two birds, One Stone: High Court Decision Clarifies the Role of Acquired Distinctiveness in the Staywell test and Provides Guidance on the Assessment of Similarity between Animal Marks

The decision in V V Technology Pte Ltd v Twitter, Inc [2022] SGHC 293 provides clarification to the controversial issue of whether acquired distinctiveness should be considered at marks-similarity stage of the Staywell test, and also provides guidance on the assessment of marks-similarity between two animal device marks.
