Winding up by the Court premised on a company’s special resolution - Re Bu Shen Xi (S) Pte Ltd (Official Receiver, non-party) [2024] SGHC 247

The Court may wind up a company if the company, has by special resolution, resolved that it be wound up by the Court (section 125(1)(a) of the Insolvency, Restructuring and Dissolution Act 2018). In a rare decision on section 125(1)(a), the Judge in Re Bu Shen Xi (S) Pte Ltd (Official Receiver, non-party) [2024] SGHC 247 laid down the factors a Court would consider when hearing applications under this provision.
