Tian Kai is a dispute resolution lawyer with experience in arbitration under the auspices of major arbitral institutions such as the SIAC, ICC and LMAA, among others, as well as in litigation across various levels of the Singapore courts.

He represents and advises clients in the avoidance, management and resolution of their disputes across a broad range of industries and areas, including construction and engineering, equity and trusts, commodities, financing and investment disputes.

Tian Kai is accustomed to working on complex and cross-border disputes, alongside foreign counsel, experts and other professionals.

Prior to joining Drew & Napier LLC, Tian Kai practised in the London and Singapore offices of a ‘magic circle’ law firm, where he worked with senior counsel and practitioners renowned in their respective fields.

Some of the matters in which Tian Kai has acted include the following:

Investment and M&A Disputes

• Representing multiple sellers in an SIAC arbitration and related proceedings in respect of a post-M&A dispute with the purchaser over breaches of warranties and earn-out payment obligation.
• Represented a holding company with substantial mining interests in Asia in an ICC arbitration against its investor for breaches of an investment agreement.
• Assisted on an SIAC arbitration worth several hundred million (US$) concerning the exit of a private equity fund from an investment agreement between the parties, involving complicated issues of Indian law.

Construction and Engineering 

• Representing an MCST of a condominium development in Singapore to pursue claims for common property defects against the developer and main contractor.
• Acting for an international contractor against its local subcontractor in relation to works for a power plant in East Asia.
• Acted for a renowned international contractor to pursue claims in connection with an oil field project in the Middle East.

Projects, Energy and Infrastructure Investment and M&A Disputes 

• Successfully obtained an award for an owner of telecommunications infrastructure against a major telecommunications operator for the lease of telecommunications towers and sites in a Southeast Asian country.
• Successfully acted for a major international contractor in an SIAC arbitration seated in Singapore in relation to disputes arising out of an iconic infrastructure project in the Middle East.
• Advised project companies and sponsors in relation to claims from their contractors arising out of the design and construction of offshore wind farms in Asia.
