Singapore | Private Examiner Appointments and Governing Law for Oral Depositions in Aid of Foreign Judicial Proceedings

In Re Dossey, James P (individually and as the executor of the estate of Dossey, Dale, deceased) and another (Mulacek, Philippe Emanuel and others, non-parties) [2026] SGHCR 39, the General Division of the High Court determined the procedural arrangements for the oral deposition of a Singapore-based witness pursuant to a Letter of Request from a Texas court under the Hague Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters.

The Court appointed a private examiner to preside over the deposition and permitted the proceedings to be video recorded, finding no prohibition under Singapore law for private examinations conducted outside the Supreme Court premises.

A team led by Directors Woo Shu Yan and Gerald Tay acted for James P. Dossey (individually and as Executor of the Estate of Dale Dossey) and Dossey & Jones, PLLC in this matter.
